The court ruled 5-4 that the government is violating the constitutional rights of prisoners. (June 12)A divided Supreme Court says foreign terror suspects held at Guantanamo Bay have the right to challenge their detention in civilian courts. It's the third high court ruling on the subject. The previous two times, the administration and the Republican-controlled Congress changed the law to block detainees from court.Writing for the five-four majority, Justice Anthony Kennedy said: "THE LAWS AND CONSTITUTION ARE DESIGNED TO SURVIVE, AND REMAIN IN FORCE, IN EXTRAORDINARY TIMES."(SOT: MICHAEL RATNER/CENTER FOR CONSTITUTIONAL RIGHTS)(13:06:35) I HAD TEARS IN MY EYES. I JUST THINK IT'S THE MOST CRITICAL DECISION WE'VE WON IN YEARS AND HOPEFULLY BEGINS TO END REALLY THE EXCESSES OF THE SO CALLED WAR ON TERROR OF THIS ADMINISTRATION. The Center for Constitutional Rights represents many of the 270 men still held at the U-S Naval base in Cuba. Among the prisoners are men considered high-value targets. In Rome, President Bush said he will look into whether new legislation is appropriate.(SOT: PRESIDENT BUSH)(13:50:12) AS TO THE SUPREME COURT'S DECISION. WE'LL ABIDE BY THE SUPREME COURT'S DECISION. THAT DOESN'T MEAN I HAVE TO AGREE WITH IT. THIS IS A DEEPLY DIVIDED COURT AND I STRONGLY AGREE WITH THOSE WHO DISSENTED. The courts most conservative members dissented. Antonin Scalia wrote that the U-S is 'at war with radical Islamists" and that the court's decision "will make the war harder on us. It will almost certainly cause more Americans to be killed."It's not clear whether the ruling will lead to prompt hearings for the detainees. America is paying the price for its crap foreign policy and they go about it by creating more enemies. There are some nut jobs who are obsessed with blowing shit up but some of those people have done nothing wrong and should be given a fair trial. Terrosism has won in america they didnt have to destroy your beliefs, constitution or way of life because they have scard the american people into destroying it themselves.

Why would anyone fear allowing a prisoner proper due process? No to do so is to condone Vietnam's indefinite holding of American POWs. Only an anti-American would want to see us become like our enemies.

There are hundreds of detainees in gitmo...only ten of them had been put to court yet and none of them could be proven guilty of being connected to Al-Quaida or any kind of terrorism at all. Just imagine for a minute that maybe ALL or MOST of those imprisoned are innocent... Can you take the responsibility of your country for holding and torturing COMPLETELY INNOCENT PEOPLE in prison for years and years not even giving them a chance to be free again ? The supreme court´s decision is right.

I said they should have a right to a fair hearing.

"According to a new report by Seton Hall Law Center for Policy and Research, "The statistic was endorsed by a Senate Minority Report issued June 26, 2007, which cites a media outlet, CNN. CNN, in turn, named the DoD as its source. The '30' number, however, was corrected in a DoD press release issued in July 2007, and a DoD document submitted to the House Foreign Relations Committee on May 20, 2008 abandons the claim entirely."

Yes Univerisity education in political science and anthropology teaches you nothing about other cultures. I think it is obvious that if anyone is ignorant it is you. Once again you call them terrorists. Tell me this. How can a 10 year old be considered a terrorist worthy of idefinite incarceration? Yes I know how many released prisoners were recaught on the battlefield. Twelve. Scalia was citing false information when he declared that there were more in his discenting opinion.
